Rules and Regulations
This page is to keep you informed of the rules and regulations which apply in North Carolina.

These are the 2T regulations as of September 1, 2006.
Poultry Operations are deemed permitted if:
1. If the operation has 30,000 or fewer birds, uses a dry litter system, and does not have a discharge. *Agronomic rates must be met if the litter is land applied.
OR:
2. If the operation has more than 30,000 birds, uses a dry litter system, do not have a discharge, and:
A. records are maintained for 3 years. This includes soil test, waste analysis results, location of fields, and application rate.
B. waste must be applied at *Agronomic rates.
C. litter is not stockpiled closer than 100ft from a perennial stream or waterbody.
D. litter is not stockpiled uncovered for more than 15 days.
E. if a manure hauler is utilized, the records must also be maintained.
Manure Hauler Operations are deemed permitted if:
1. the application is 100 tons or less per calendar year, application is at *Agronomic rates, and a 25 ft buffer is maintained by a perennial stream or waterbody.
OR:
2. the application is more than 100 tons per calendar year and:
A. the application is at *Agronomic rates.
B. litter is not stockpiled uncovered for more than 15 days.
C. litter is not stockpiled closer than 100ft from a perennial stream or waterbody.
D. a buffer of 25ft is maintained from a perennial stream or waterbody
E. registers with the Division of Water Quality.
F. the Hauler submits an annual report. This includes name, address, and phone number of the Hauler; date, location, and amount of litter received, as well as date, location, and acreage of application. For Haulers applying more than 750 tons per year must also include a waste analysis and the receiving crop.
G. there must have been a soil test within the previous 3 years.
Land application sites under separate ownership from the producer are deemed permitted if they are receiving waste from animal waste management systems that are themselves deemed permitted, the waste is applied at *Agronomic rates, and a vegetative buffer of 25ft or more is maintained from a perennial stream or waterbody. The producer must keep records of the name, address, and phone number of the applicator, amount of litter removed, must provide waste analysis reports and a copy of the guidelines to the applicator.
